Ying's J.S.D. dissertation addresses the increasing tension between investment protection and environmental protection under international law. Based on an examination of international investment arbitration jurisprudence since the 1990s, the dissertation analyzes the inconsistent approaches adopted by tribunals in assessing host states' environmental measures in international investment arbitration. It proposes an integral methodology to distinguish between non-compensable legitimate environmental regulation by host states and violations of international investment obligations that require compensation paid by host states to foreign investors.
