Commercial Litigation Financing: Challenges and Opportunities

Commercial litigation can be expensive and protracted, particularly high stakes litigation against well-funded defendants. Many parties with meritorious claims may be unable to pursue them without outside funding, or have other capital needs they would prioritize over paying for lawyers. Third party litigation funding arrangements can provide capital for companies to offset their litigation risk or supplement their operating budget while pursuing their legal claims. Although it promotes access to justice, litigation funding implicates a diverse array of issues ranging from civil procedure, to legal ethics, to the business of law, and has accordingly attracted attention from courts, bar organizations, regulatory, and quasi-regulatory bodies. Please join our distinguished panelists to consider some of the challenges and opportunities commercial litigation funding can present. The panel will also consider career opportunities commercial litigation funding can provide to lawyers interested in finance, risk management, and substantive areas including patent and intellectual property law that frequently engender significant litigation costs.

Victoria Cundiff '80, YLS Visiting Lecturer in Law and Fellow of the YLS Center for the Study of Corporate Law, will moderate this discussion.
