Professor Roberts disccusses her papers "Trademark Failure to Function" and "Mark Talk". Both are about assessing trademark use to establish trademark rights, with a focus on producers’ use in the first work and consumers’ use in the second. 

Alexandra J. Roberts is an Associate Professor at the University of New Hampshire School of Law. She teaches and writes in the areas of trademarks and unfair competition, entertainment law, contracts, and law and literature. Her current scholarship focuses on trademark use and distinctiveness generally and how trademarks function on social media in particular. Professor Roberts holds an AB from Dartmouth College, an AM from Stanford University, and a JD from the Yale Law School. She currently serves as Interim Director of the Franklin Pierce Center for Intellectual Property at UNH School of Law and co-chair of the Junior IP Scholars Association. She also co-leads UNH Law’s Sports & Entertainment Law Institute.
