The Department of Justice launched a “China Initiative” in 2018 to counter national security threats emanating from the People’s Republic of China. In an important new article, Professor Margaret K. Lewis investigates the China Initiative and argues that, despite legitimate concerns about the PRC party-state’s involvement in violations of U.S. law, the U.S. government’s use of criminal prosecutions to address a broad “China” threat is, at best, in tension with foundational principles of the United States’ criminal justice system.
