Disciplining the Trump Election Lawyers: Is There a First Amendment Defense?

Rudy Giuliani, John Eastman, Sidney Powell, Kenneth Chesebro, and Jenna Ellis are among the lawyers who have been subject to disciplinary charges arising from their representation of former President Trump in connection with the 2020 election. These cases raise novel questions of legal ethics, regulation of the legal profession and to what extent the public utterances by licensed lawyers on behalf of their client  –  even those acknowledged to be false or misleading -  should be off-limits to disciplinary authorities under the First Amendment.

Visiting Lecturer in Law David Atkins ’81 will moderate a discussion on the topic between Prof. Rebecca Roiphe (New York Law School) and Dean Erwin Chemerinsky (U.C Berkeley School of Law).
