West Virginia v. EPA, Climate Organizing, and the Fate of the Regulatory State

Please join the Yale Environmental Law Association for a lively discussion about the future of climate policy and administrative law. Our distinguished panelists (Professor Cristina Rodríguez, Professor Leah Litman, and Jean Su, Energy Justice Program Director at the Center for Biological Diversity) will analyze the Supreme Court’s decision in West Virginia v. EPA, which invoked the “major questions doctrine” to hamstring the Environmental Protection Agency’s ability to regulate greenhouse gas emissions. They will also assess the climate and energy provisions of the recently-passed Inflation Reduction Act and discuss the next frontier of efforts to tackle the climate crisis and grapple with the fate of our constitutional order. Lunch will be provided for in-person attendees.
